Our position on Genocide

A position on genocide in general is a given – it is the crime of all crimes, sits at the absolute apex of international crimes against humanity with a special category that separates it from other crimes by a special requirement: prevention.
The 1948 UN Convention on the Prevention and Punishment of Genocide* (‘Genocide convention’) is unique in its preventive aspect.
It should not be necessary to state that one is against genocide – even many of those who are actively committing it say they oppose it. Alas, denial of genocide is often part of the means by which it is perpetrated in real time.
The focus of this text is to formulate our position on the genocide being committed in Gaza , at the hands of the Israeli occupation regime.
Less than a week after October 7th 2023, following numerous genocidal statements and actions of the Israeli leadership already at that point, Israeli-American genocide scholar Raz Segal wrote “A textbook case of Genocide” in Jewish Currents:
“Israel ordered the besieged population in the northern half of the Gaza Strip to evacuate to the south, warning that it would soon intensify its attack on the Strip’s upper half. The order has left more than a million people, half of whom are children, frantically attempting to flee amid continuing airstrikes, in a walled enclave where no destination is safe”, he wrote.
These words could be written today, as we formulate this position paper. It has been a constant pattern of displacement amidst bombing, where no destination is safe. As Yoav Gallant, Israel's defence minister at the time, stated, Palestinians are indeed handled as "human animals". The International Criminal Court has issued a warrant for his arrest for war crimes and crimes against humanity.
“Israel’s goal is to destroy the Palestinians of Gaza”, Segal summarized, “and those of us watching around the world are derelict in our responsibility to prevent them from doing so”.
For nearly two years, the situation has gone from bad to worse. Gaza, both city and region are decimated. The population is completely dependent on humanitarian aid for survival which is hindered by Israel. The international mechanism for such aid has likewise been decimated. Instead, Israel has set up too few, dysfunctional food distribution centres, manned by American mercenaries. On a daily basis, those seeking food there are massacred.
Serious legal attempts have been made, to prevent the very worst – like South Africa’s submittal of the case against Israel for Genocide, at the International Court of Justice in December 2023. When the court accepted the case in January 2024, it also ordered provisional measures to prevent “irreparable harm” to the Palestinians under the Genocide Convention, as the court entered its long process of adjudicating the matter further. Israel did not abide by this order. The court repeated the order with specifics in March and May of the same year. Israel’s failure to prevent genocide is today seen in the countless photos and videos of starving children. About a quarter of Gaza’s population is today at the highest level of starvation, that is, “famine”, as classified by the UN. The rest are at high levels of starvation. “Famine is not only about food; it is the deliberate collapse of the systems needed for human survival,” said UN Secretary-General Antonio Guterres. “People are starving. Children are dying. And those with the duty to act are failing.”
Many of those seeking to delay pressure on Israel, argue that since the case at the ICJ is still in progress, we cannot act against Israel before the final judgement. But the Genocide Convention mandates action when there is a serious risk of genocide, and the court pointed out there there is such a risk. The court acted through temporary measures, but Israel has not abided by them.
Meanwhile, international consensus on the fact of genocide has been growing, including many experts, scholars and human rights organisations, including Amnesty, Human Rights Watch, Israeli B’tselem, Lemkin Institute for Genocide Prevention, Doctors Without Borders, the UN independent International Commission and a host of the most respected international genocide scholars. Some emphasize the lack of prevention of starvation and destroying access to water, some emphasize the destruction of health facilities and prevention of access to medicine or baby formula. Others emphasize the deliberate killing and maiming of civilians, many of whom are children, or the constant relocation of hundreds of thousands of civilians without access to proper facilities. All of them emphasize the deliberate intention with which these atrocities are committed.
Genocide does not require final judgement from a court in some years’ time to confirm that it is happening. USA has determined the Myanmar Rohingya case a genocide before the matter is adjudicated at ICJ – so the argument about waiting is vacuous, and betrays political bias.
Genocide must be stopped and prevented, always. This is also where we, with our Jewish background, who carry the terrible legacy of the Nazi holocaust, must say "never again" and why we refuse to let anyone use the safety of Jews as a shield from criticism. We say “not in our name” when atrocious acts are carried out pretending it has to do with self-defense. We will use the right words for what Israel is doing. Calling it a "war" or talking about "self-defense" does not do the situation justice. Avoiding the right words for what is happening only serves to prolong a genocidal status quo.
We state outright: This is a genocide and it must be stopped.

In the present Convention, genocide means any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such:
Killing members of the group;
Causing serious bodily or mental harm to members of the group;
Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part;
Imposing measures intended to prevent births within the group;
Forcibly transferring children of the group to another group.

En holdning til folkedrab i almindelighed er givet; det er den ultimative forbrydelse, det absolutte toppunkt for internationale forbrydelser mod menneskeheden i en særlig kategori, der adskiller den fra andre forbrydelser med et særligt krav: Forebyggelse.
FN's konvention fra 1948 om forebyggelse og straf af folkedrab* (Folkedrabskonventionen) er enestående i sit forebyggende aspekt.
Det burde ikke være nødvendigt at slå fast, at man er imod folkedrab - selv mange af dem, der aktivt begår det, siger at de er imod det. Selve benægtelsen af folkedrab er ofte en del af den måde, hvorpå det begås i realtid.
Fokus i denne tekst er at udfolde vores holdning til det folkedrab, der bliver begået i Gaza af den israelske besættelsesmagt.
Mindre end en uge efter den 7. oktober 2023, efter adskillige folkedrabserklæringer og -handlinger fra den israelske ledelse allerede på det tidspunkt, skrev den israelsk-amerikanske folkedrabsforsker Raz Segal "A textbook case of Genocide" i Jewish Currents:
"Israel beordrede den belejrede befolkning i den nordlige halvdel af Gaza-striben til at evakuere mod syd og advarede om, at den snart ville intensivere sit angreb på stribens øverste halvdel. Ordren har efterladt mere end en million mennesker, hvoraf halvdelen er børn, i et febrilsk forsøg på at flygte midt i fortsatte luftangreb, indespærret i en enklave, hvor ingen destination er sikker", skrev han.
Disse ord kunne skrives i dag, mens vi formulerer dette positionspapir. Der er foregået konstant fordrivelse af befolkningen i Gaza under bombardementer, hvor ingen destination har været sikker. Som Yoav Gallant, Israels forsvarsminister på det tidspunkt udtalte, bliver palæstinensere faktisk behandlet som "menneskedyr". Den Internationale Straffedomstol har udstedt en arrestordre på ham for krigsforbrydelser og forbrydelser mod menneskeheden.
"Israels mål er at udslette palæstinenserne i Gaza", opsummerede Segal, "og de af os, der ser til fra resten af verden, forsømmer vores ansvar for at forhindre dem i at gøre det".
I næsten to år er situationen gået fra slemt til værre. Gaza, både by og region, er decimeret. Befolkningen er fuldstændig afhængig af humanitær hjælp for at overleve, men den bliver forhindret af Israel. Den internationale mekanisme for en sådan bistand er ligeledes blevet decimeret. I stedet har Israel oprettet for få, dysfunktionelle fødevaredistributionscentre, bemandet af amerikanske lejesoldater. På daglig basis dræbes folk, der søger mad der.
Seriøse juridiske skridt er taget for at forhindre det i at blive værre – som Sydafrikas indbringelse af sagen om folkedrab mod Israel for Den Internationale Domstol (ICJ) i december 2023. Da domstolen accepterede sagen i januar 2024, beordrede den også foreløbige foranstaltninger for at forhindre "uoprettelig skade" på palæstinenserne under folkedrabskonventionen, mens domstolen indledte sin lange sagsbehandling. Israel overholdt ikke ordrerne. Domstolen gentog og specificerede sine ordrer i marts og maj samme år. Israels manglende vilje til at forhindre folkedrab ses i dag på de utallige billeder og videoer af sultende børn. Omkring en fjerdedel af Gazas befolkning er i dag på det højeste niveau af sult, betegnet som "hungersnød", som klassificeret af FN. Resten er på høje niveauer af sult. "Hungersnød handler ikke kun om mad; det er det overlagte sammenbrud af de systemer, der er nødvendige for menneskets overlevelse," sagde FN's generalsekretær Antonio Guterres. "Folk sulter. Børn dør. Og dem, der har pligt til at handle, fejler."
Mange af dem, der forsøger at forsinke presset på Israel, hævder, at når en sag ikke er færdigbehandlet ved ICJ, kan vi ikke handle mod Israel. Vi skal vente på den endelige dom. Men folkedrabskonventionen kræver, at man handler, når der er en alvorlig risiko for folkedrab, og Den Internationale Domstol pegede på en sådan risiko. Domstolen pålagde midlertidige foranstaltninger, som ikke blev gennemført.
I mellemtiden er den internationale konsensus om, at der pågår et folkedrab, vokset. Det omfatter bl.a. Amnesty, Human Rights Watch, israelske B'tselem, Læger Uden Grænser, Den uafhængige FN-undersøgelseskommission og et væld af de mest respekterede internationale folkemordsforskere. Nogle lægger vægt på manglende forebyggelse af sult og ødelæggelse af adgangen til vand, andre på ødelæggelsen af sundhedsfaciliteter og forhindring af adgangen til medicin eller modermælkserstatning. Andre igen på de overlagte drab på og lemlæstelse af civile, hvoraf en stor del er børn eller på den konstante relokering af hundredetusinder af civile uden adgang til ordentlige faciliteter. Alle understreger den bevidste hensigt, hvormed disse grusomheder begås.
Folkedrab kræver ikke en endelig dom fra en domstol om nogle år for at bekræfte, at det sker. USA har for eksempel fastslået, at Myanmar Rohingya-sagen er et folkedrab, før sagen er afgjort ved ICJ - så argumentet om at vente er tomt og afslører en politisk bias.
Folkedrab skal stoppes og forhindres, altid. Det er også her, at vi med vores jødiske baggrund, som bærer på den frygtelige arv fra nazisternes holocaust, må sige ”aldrig igen", og derfor nægter vi at lade nogen bruge jøders sikkerhed som et skjold mod kritik. Vi siger »ikke i vores navn«, når de grusomme handlinger udføres under påskud af, at det har noget med selvforsvar at gøre. Vi vil bruge de rigtige ord for det, Israel gør. At kalde det en "krig" eller tale om "selvforsvar" yder ikke situationen retfærdighed. At undgå de rigtige ord for, hvad der sker, tjener kun til at forlænge folkedrabets status quo.
Vi slår derfor fast: Dette er et folkedrab, og det skal stoppes.

I nærværende konvention forstås ved folkedrab enhver af nedennævnte handlinger, der begås i den hensigt helt eller delvis at ødelægge en national, etnologisk, racemæssig eller religiøs gruppe som sådan:
